Arizona Court Tosses Sentence After AI Victim Video Was Used
By Avery Collins. Oct 6, 2026
An Arizona appeals court has thrown out Gabriel Paul Horcasitas’ manslaughter sentence after an AI-generated video depicted the deceased victim, Christopher Pelkey, speaking during sentencing. The conviction remains intact, but Horcasitas must be sentenced again.
Pelkey’s family created the video from his image, a prior recording and a script written by his sister. The trial judge praised the presentation before imposing the sentence, turning what had been presented as a new way to give a victim a voice into the central issue on appeal.
The Appeals Court Drew a Line Between Family Expression and Reliable Evidence
Arizona allows victims and families to address a sentencing court, including through recorded statements. The appeals court concluded this AI-generated depiction was different because the words were not Pelkey’s and the synthetic presentation could not reliably represent what he would have said.
The Ruling Changes the Sentence Without Erasing the Conviction
Horcasitas remains convicted of manslaughter. The appellate remedy is resentencing, which means the case returns to the punishment stage rather than restarting the criminal case from the beginning.
The Original Judge’s Reaction Made the Technology Hard to Treat as Harmless
At the original sentencing, the judge spoke positively about the AI video. The appeals court found the use of the synthetic statement created a fairness problem serious enough to require a new sentencing hearing.
The Second Hearing Will Test How Courts Handle Synthetic Victim Speech
The immediate consequence is a new sentence for one defendant, but the broader significance is procedural. Courts now have an appellate ruling warning that an AI recreation of a dead person’s voice and views cannot simply be treated like an ordinary victim statement.
