Adam Montgomery Retrial Set as Search for Harmony Continues

Retrial Scheduled for October 2027

Adam Montgomery is scheduled to face a second murder trial in October 2027 after the New Hampshire Supreme Court overturned his conviction in the death of his daughter Harmony.

Montgomery was convicted of second-degree murder in 2024. The state Supreme Court reversed that conviction in June 2026 and ordered a new trial, finding that the original case structure created an unfair risk to his right to a fair proceeding.

His convictions for assault, falsifying physical evidence, witness tampering and abuse of a corpse remain in place. Montgomery has maintained his innocence in Harmony’s death.

Supreme Court Ruling Changed the Murder Case

The 2024 trial included evidence about an earlier assault on Harmony as well as the later murder allegation. The Supreme Court concluded jurors may have relied on stronger assault evidence when evaluating the murder charge.

The attorney general’s office asked the court to reconsider, but that request was denied in July.

NBC10 Boston reported that the new trial is set for Oct. 27, 2027. Montgomery did not attend the recent scheduling hearing.

Prosecutors Say Harmony’s Remains Are Still Missing

Harmony was reported missing in 2021. Investigators believe she died in 2019, and her remains have never been recovered.

Boston 25 News reported that authorities conducted another search last month in a different area but did not find her. Senior Assistant Attorney General Ben Agati told the court that investigators are still looking.

Authorities have previously focused on a route into Massachusetts linked to a rental truck Montgomery used after Harmony’s death, according to reporting on the case.

Both Sides Are Preparing for Another Trial

Lawyers told the court that they will need to review thousands of pages of material and assess how the Supreme Court ruling affects the evidence allowed at retrial.

The new trial will address the second-degree murder charge only under the revised legal framework. Montgomery’s remaining convictions are unaffected by the retrial schedule.

The state will again have to prove the murder charge beyond a reasonable doubt.

Search and Court Proceedings Continue on Separate Tracks

The case now has two active paths. Prosecutors are preparing to retry the murder allegation, while investigators continue searching for Harmony’s remains.

The retrial date gives the court process a schedule. The location of Harmony remains unresolved.

The Original Conviction Still Shapes the Retrial

Montgomery’s first jury returned guilty verdicts on multiple counts in 2024. Only the second-degree murder conviction was reversed on appeal, leaving the other findings in effect.

The Supreme Court’s decision focused on how evidence from the assault allegation may have influenced the murder count. That means lawyers now have to rebuild the murder case around evidence that can be presented without recreating the same problem.

Prosecutors and defense attorneys told the court the preparation will require extensive review of prior filings, witness material and rulings. The October 2027 date gives both sides more than a year to prepare.

Meanwhile, investigators say the search for Harmony is continuing independently of the court schedule.

Harmony Was Missing Long Before the First Trial

Harmony was reported missing in late 2021, triggering a search that eventually became a homicide investigation. Prosecutors later said they believed she had died in 2019.

The absence of recovered remains did not prevent the state from bringing the original murder case, and it will not prevent the retrial. Prosecutors can again rely on witness testimony, records and circumstantial evidence, subject to the limits created by the Supreme Court ruling.

The renewed search activity shows that investigators are still trying to answer a factual question that the first verdict could not resolve: where Harmony’s remains are located.

That unresolved search will continue even as lawyers prepare for the 2027 trial date.
